BROWARD COUNTY ENVIRONMENTAL PERMITTING DIVISION (EPD) NOTICE OF PROPOSED AGENCY ACTION The Broward County Environmental Permitting Division (EPD) gives notice that it proposes to approve a No Further Action with Conditions and issue a Site Closure Letter with conditions for property located in the vicinity of Flamingo Road and Orange Drive in Davie, Broward County, Florida. AG EHC II (LEN) Multi State 1, LLC, a Delaware limited liability company, is seeking this closure letter in connection with Environmental Assessment and Remediation (EAR) License No. 1403 and intends to restrict exposure to contamination by instituting: a groundwater use restriction, and engineering controls in certain areas consisting of impervious surfaces or 2 feet of clean fill. Complete copies of the EAR License, the No Further Action with Conditions Proposals, the draft restrictive covenants, and EPDs preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 4:30 p.m. Monday through Friday, except legal holidays at EPD, One North University Drive, Mailbox 201, Plantation, Florida 33324. Local governments with jurisdiction over the property subject to the Institutional and Engineering Controls, real property owner(s) of any property subject to the Institutional and Engineering Controls, and residents of any property subject to the Institutional and Engineering Controls have 30 days from publication of this notice to provide comments to the EPD.
