NOTICE OF PROPOSED AGENCY ACTION

The Florida Department of Environmental Protection ("FDEP") gives notice that it proposes to approve use of an institutional control in the form of a Recorded Environmental Declaration of Restrictive Covenant ("Declaration") at an impacted site and issue a Site Rehabilitation Completion Order with Conditions ("Conditional SRCO") for the impacted site. Boos Development Group, Inc. ("Boos Development") is seeking this Declaration and Conditional SRCO in reference to FDEP site number, ERIC_18238, Former Krystal Cleaner located is 8192 NW 103rd Street, Hialeah Gardens, Miami- Dade County, Florida, Folio Number 27-3003-001-0105 ("Site"), to restrict exposure to impacts in the following manner with groundwater use restrictions and a cap over impacted soil.

Complete copies of the Declaration and FDEP's preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays at FDEP Southeast District Office, 3301 Gun Club Road, West Palm Beach, FL 33406, or available for public inspection online at OCULUS, the FDEP online document management system. at https://depedms.dep.stat.fl.us/Oculus. Please use the ERIC_18238 to communicate with FDEP or OCULUS.

Local governments with jurisdiction over the property or any party holding a materially affected encumbrance in the area subject to the Institutional Control have 30 days from publication of this notice to provide comments to the FDEP.
