NOTICE OF SPECIAL MEETING AND ATTORNEY-CLIENT SESSION
UPPER CAPTIVA FIRE & RESCUE DISTRICT
Notice of a Special Meeting and Attorney-Client Executive Session is hereby given following a request from legal counsel for the Upper Captiva Fire & Rescue District ("District"). A Special Meeting and Attorney-Client Session of the District is hereby scheduled to commence at 10:00 AM on January 31, 2025 at the District's Fire Station located at 4511 Hodgepodge Lane, Captiva, Florida, for the purposes of hearing the District's Legal Counsels' request for Fire Commissioner advice and direction relating to settlement negotiations and/or strategy sessions associated with litigation expenditures in the case currently pending in the United States District Court Middle District of Florida in the following matter: Martin v. Upper Captiva Fire & Rescue District, Case No. 2023 CV 00388.
Pursuant to Section 286.011(8) Florida Statutes, the Attorney-Client Session will convene immediately following the opening of the Special Meeting in the District's Fire Station. The subject of the Attorney-Client Session meeting shall be confined to the topics allowed by Florida Statutes 286.011(8). It is anticipated that the Attorney-Client Session will last approximately 1-2 hours. Those individuals who will attend the Attorney-Client Session will be announced and include: the District's Fire Commissioners Duncan Rosen, Van Hammond, William Fry, Steve Holt, and Mary Jo Yafchak; the District's legal counsel Maggie D. Mooney, Melanie H. Everett, and Ron M. Campbell; and the District's Fire Chief Jesse Cottrell. One or more of the participants may appear remotely.
A certified court reporter will be in attendance. A transcript shall be made part of the public record upon conclusion of the pending litigation. At the conclusion of the Attorney-Client Session, the Special Meeting will be reopened to the public, the Attorney-Client Session's termination shall be announced, and the Board of Fire Commission may elect to take Board action relating to the pending litigation.
