NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of West Palm Beach.
REQUEST FOR RELEASE OF FUNDS
On or about February 17, 2025 the City of West Palm Beach will submit a request to Florida Department of Commerce (FLCommerce) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to redevelop Currie Park located at 2400 N Flagler Dr, West Pam Beach, FL 33407. The purpose of this project is to reduce flood risks through various strategies including resilient seawalls, mangrove living shorelines, ecological habitat enhancements, stormwater retrofits, site grading, green infrastructure, establishing a resilience hub and reducing the effects of extreme heat. The proposed upland activities include importing approximately 35,000 CY of fill. The proposed surface water activities include disturbance to 1.14 acres seaward of the mean high water line for the removal of docks/bulkhead and construction of proposed structures including mangrove living shorelines with a net benefit of an additional net gain of 5,573 SF of planting area (in addition to the 7,419 SF that is to remain). Prior to construction activities turbidity control devices will be installed in a manner to contain disturbed sediments within the limits of construction of the Project. Public recreational opportunities will be temporarily affected by construction but will benefit after the proposed works are added. This project will be completed with $16,764,610.00 of Community Development Block Grant Mitigation (CDBG-MIT) funding and Florida Department of Environmental Protection (FDEP) and City of West Palm Beach leveraged funds.
FINDING OF NO SIGNIFICANT IMPACT
The City of West Palm Beach has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 401 Clematis Street, 3rd Floor, West Palm Beach, FL 33401 and may be examined or copied weekdays 9 A.M to 5 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of West Palm Beach Department of Parks and Recreation. All comments must be received by February 14th, 2025. Comments will be considered prior to the City of West Palm Beach requesting a release of funds. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The City of West Palm Beach certifies to Florida Commerce and HUD that Leah Rockwell in her capacity as Director of Parks and Recreation consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The States approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of West Palm Beach to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
FLCommerce will accept objections to its release of funds and the City of West Palm Beach certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of West Palm Beach; (b) the City of West Palm Beach has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to Florida Department of Commerce, CDBG Program, MSC-400 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the City of West Palm Beach to verify the actual last day of the objection period.
