NOTICE OF ESTOPPEL AND STIPULATION OF CONSTITUTIONAL CHALLENGE TO ALL MASSACHUSETTS AND UNITED STATES STATUTES WHERE Retrospective laws are highly injurious, oppressive, and unjust. No such laws, therefore, should be made, either for the decision of civil causes, or the punishment of offenses AND MOTION TO INTERVENE WITH AN INJUNCTION FOR THE NAME LEGATUM IMPERATORIS EXPRESS TRUST doing business as GERARDO MARIANO JR. AND GERARDO NOBILUOMO, DUCA OF BOSTON Per Exhibit GR1-039423 (Trademark License Agreement)
All constitutional civil officers have given oath to the support the constitution of Massachusetts and the United States as prescribed in Part II, Chapter VI, Article I of the Massachusetts 1780 Constitution. The Complainant (One of The People of the Territory of Massachusetts under Declaration of Express Trust), rights protected by the Constitution (Article XII (Declaration of Rights) have been injured in the past by the Sheriffs and his/her officers by being compelled to accuse or furnish evidence against himself. Every subject shall have a right to produce all proofs that may be favorable to himself; to meet the witnesses against him face to face, and to be fully heard in his defense, by himself, and counsel. complaint under oath attached to the summons, citation or notice of violation without special designation of the persons or objects of search, arrest, or seizure (Article XIV). As prescribed in Massachusetts Rules of Civil Procedure Rule 4; (a) Summons: Issuance Upon the commencement of the action, the plaintiff or the plaintiffs attorney shall deliver a copy of the complaint and a summons for service to the sheriff or deputy sheriff, special sheriff, or any other person authorized by law to serve process, or to some person specially appointed by the court for that purpose. Upon request of the plaintiff, separate or additional summonses shall issue against any defendants. The summons may be procured in blank from the clerk and filled in by the plaintiff or the plaintiffs attorney as provided in subdivision (b) of this rule. (b) Form of Summons; The summons shall bear the signature or facsimile signature of the clerk, be under the seal of the court, and contain the name of the court and the names of the parties. It shall be directed to the defendant, state the name and address of the plaintiffs attorney (if any), otherwise the address of the plaintiff, and the time within which these rules require the defendant to appear and defend. It shall notify the defendant that in case of the defendants failure to do so, judgment by default will be rendered against the defendant for the relief demanded in the complaint. The summons shall be in the name of the Commonwealth of Massachusetts and bear the teste of the first justice of the court to which it shall be returnable, who is not a party to the action. (c) Service Service of all process shall be made by a sheriff, his deputy, a special sheriff, or by any other person duly authorized by law, or by some person specially appointed by the court for that purpose. In the event of service outside the Commonwealth, it may be made by a person permitted to make service under the law of this Commonwealth, or under the law of the place in which service is to be made, or who is designated by a court of this Commonwealth. (d) Summons: Personal Service Inside the Commonwealth The summons and complaint shall be served together. The plaintiff shall furnish the person making service with such copies as are necessary. Service shall be made as follows: Upon an individual by delivering a copy of the summons and complaint to the individual personally, or by leaving copies at the individuals last and usual place of abode, or by delivering to an authorized agent. Upon a domestic corporation or partnership by delivering copies to an officer, managing or general agent, or by leaving copies in the office of such agent with the person then in charge. Upon the Commonwealth or its agencies/officers by delivering copies to the Attorney General (or designee) and to the officer or agency involved.
DEMAND FOR RELIEF
FURTHERMORE, I DEMAND , for the MIDDLESEX County Sheriff to put the name LEGATUM IMPERATORIS EXPRESS TRUST doing business as MARIANO JR., GERARDO AND GERARDO MARIANO JR. AND GERARDO NOBILUOMO, DUCA OF BOSTON on THE DO NOT STOP, DO NOT DETAIN LIST FOR MASSACHUSETTS and all OTHER STATES under Full Faith and Credit . The Constitution reserves all rights protected by the above said 1780 Constitution of Massachusetts, the Articles of Association and the Articles of Confederation and do not waive any part of my rights; abide by your oaths to it .
TAKE JUDICIAL NOTICE THAT THIS WRIT OF INJUNCTION SHALL ALSO SERVE AS YOUR CONTRACT; failure to answer and rebut this Writ is acquiescence and is estoppel; you have 30 days to answer , then this contract is law. No STATE shall pass and Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts Section 10 of 1787 United States Constitution.
