A RESOLUTION OF THE CITY COMMISSION OF KISSIMMEE, FLORIDA CALLING FOR MUNICIPAL REFERENDUMS TO AMEND THE CITY CHARTER; SETTING THE DATE OF THE REFERENDUMS TO BE AUGUST 18, 2026, AND PROVIDING FOR NOTICE THEREOF; ESTABLISHING THE BALLOT TITLES AND QUESTIONS FOR REFERENDUMS; AND PROVIDING FOR AN EFFECTIVE DATE

WHEREAS, Article III, Chapter 1, Section 1 of the Charter of the City of Kissimmee provides for the date General Municipal Elections are held; and

WHEREAS, the City Commission of the City of Kissimmee proposes two (2) charter amendments subject to approval by the electorate via referendum; and

WHEREAS , the City Commission desires to submit the two (2) proposed Charter amendments to the qualified electors of the City of Kissimmee for approval or rejection at the General Municipal Election to be held on August 18, 2026; and

WHEREAS, notice of the proposed Charter Amendments must be provided as required by law; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF KISSIMMEE:

Section 1. Referendum Called. A municipal referendum is hereby called to submit proposed amendments to the Charter of the City of Kissimmee to the qualified electors of the City. Such referendum shall be held in conjunction with the General Municipal Election on August 18, 2026, during the legal hours of voting, for the purpose of voting upon the proposed Charter amendments described herein.

Section 2. Charter Amendments to be Submitted. The following proposed Charter Amendments shall be submitted to the electors of the City of Kissimmee for consideration:

REFERENDUM 1:

Shall the City Charter, Chapter 2, Section 2, be amended to revise the term limits for the Mayor-Commissioner and City Commissioners from two (2) consecutive four-year terms to three (3) consecutive four-year terms?

REFERENDUM 2 :

Shall the City Charter, Chapter 2, City Commission, Section 7, be amended to require all candidates for elected office to consent to a background check to verify eligibility for office?

Section 3. Ballot Form. The proposed Charter Amendments shall appear on the ballot in the following form:

Section 4. Notice of Referendum. The City Clerk shall provide Notice of the Referendums in the manner required by law and shall publish such notice in a newspaper of general circulation within the City of Kissimmee at least ten (10) days prior to the date of the election.

Section 5. Election Administration. The City Clerk is hereby authorized and directed to coordinate with the Osceola County Supervisor of Elections to ensure the placement of the proposed Charter Amendments on the ballot and to take all actions necessary to conduct the referendum election, including a provisional review of the ballot, in accordance with applicable law.

Section 6. Effective Date. This resolution shall take effect immediately upon adoption.

UNA RESOLUCIN DE LA COMISIN DE LA CIUDAD DE KISSIMMEE, FLORIDA, POR LA QUE SE CONVOCA A REFERNDUMS MUNICIPALES PARA ENMENDAR LA CARTA CONSTITUCIONAL DE LA CIUDAD; SE ESTABLECE LA FECHA DE LOS REFERNDUMS PARA EL 18 DE AGOSTO DE 2026 Y SE DISPONE SU NOTIFICACIN; SE ESTABLECEN LOS TTULOS Y LAS PREGUNTAS DE LAS BOLETAS DE VOTACIN PARA LOS REFERNDUMS; Y SE ESTABLECE UNA FECHA DE ENTRADA EN VIGOR

CONSIDERANDO QUE , el Artculo III, Captulo 1, Seccin 1 de la Carta Constitucional de la Ciudad de Kissimmee establece la fecha en que se llevarn a cabo las Elecciones Municipales Generales; y

CONSIDERANDO QUE, la Comisin de la Ciudad de Kissimmee propone dos (2) enmiendas a la Carta Constitucional sujetas a la aprobacin del electorado por medio de un referndum; y

CONSIDERANDO QUE , la Comisin desea someter las dos (2) enmiendas propuestas a la Carta Constitucional a los electores calificados de la Ciudad de Kissimmee para su aprobacin o rechazo en la Eleccin Municipal General que habr el 18 de agosto de 2026; y

CONSIDERANDO QUE , se debe proporcionar la notificacin de las enmiendas propuestas a la Carta Constitucional segn lo exige la ley; y

POR LO TANTO, SE RESUELVE POR LA COMISIN DE LA CIUDAD DE KISSIMMEE:

Seccin 1. Convocatoria de Referndum. Por la presente, se convoca un referndum municipal para someter a los electores calificados de la Ciudad las enmiendas propuestas a la Carta Constitucional de la Ciudad de Kissimmee. Dicho referndum se celebrar conjuntamente con la Eleccin Municipal General del 18 de agosto de 2026, durante el horario legal de votacin, con el propsito de votar sobre las enmiendas propuestas a la Carta Constitucional que se describen en el presente documento.

Seccin 2. Enmiendas a la Carta Constitucional que se Sometern a Votacin. Las siguientes enmiendas propuestas a la Carta Constitucional se sometern a la consideracin de los electores de la Ciudad de Kissimmee:

REFERNDUM 1:

Debe enmendarse la Carta Constitucional de la Ciudad, Captulo 2, Seccin 2, para revisar los lmites de mandato del Alcalde-Comisionado y de los Comisionados de la Ciudad, pasando de dos (2) mandatos consecutivos de cuatro aos a tres (3) mandatos consecutivos de cuatro aos?

REFERNDUM 2 :

Debe enmendarse la Carta Constitucional de la Ciudad, Captulo 2, Comisin de la Ciudad, Seccin 7, para exigir que todos los candidatos a cargos electos den su consentimiento para una verificacin de antecedentes con el fin de comprobar su elegibilidad para el cargo?

Seccin 3. Formato de la Boleta Electoral. Las Enmiendas propuestas a la Carta Constitucional aparecern en la boleta electoral en el siguiente formato:

PREGUNTA DEL REFERNDUM 2:

TTULO: Enmendar los requisitos de calificacin de los candidatos para exigir la verificacin de antecedentes penales.

Debe enmendarse la Carta Constitucional de la Ciudad, Captulo 2, Comisin de la Ciudad, Seccin 7, para exigir que todos los candidatos a cargos electos den su consentimiento para una verificacin de antecedentes con el fin de comprobar su elegibilidad para el cargo?

Seccin 4. Aviso del Referndum. La Secretara Municipal proporcionar el Aviso de los Referndums en la forma requerida por la ley y publicar dicho aviso en un peridico de circulacin general dentro de la Ciudad de Kissimmee con al menos diez (10) das de antelacin a la fecha de la eleccin.

Seccin 5. Administracin de la Eleccin. Por la presente, se autoriza y ordena a la Secretara Municipal coordinar con el Supervisor de Elecciones del Condado de Osceola para asegurar la inclusin de las Enmiendas propuestas a la Carta Constitucional en la boleta electoral y para tomar todas las medidas necesarias para llevar a cabo la eleccin del referndum, incluida una revisin provisional de la boleta, de conformidad con la ley aplicable.

Seccin 6. Fecha de Entrada en Vigor. Esta resolucin entrar en vigor inmediatamente tras su aprobacin.
