NOTICE OF PUBLIC HEARING OSCEOLA COUNTY BOARD OF COUNTY
COMMISSIONERS ADOPTION OF ORDINANCE
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Osceola County, Florida, will hold a Public Hearing on Monday, August 17, 2026, at 5:30 p.m., or as soon thereafter as possible, in the County Commissioners Chambers, Osceola County Administration Building, 1 Courthouse Square, Suite 4100, Kissimmee, Florida 34741, to consider adoption of the following ordinance:
ORDINANCE #2026-51
AN ORDINANCE OF THE OSCEOLA COUNTY BOARD OF COUNTY COMMISSIONERS, AMENDING THE OSCEOLA COUNTY CODE OF ORDINANCES, CHAPTER 20, ARTICLE III LOCAL PROVIDER PARTICIPATION FUND; PROVIDING FOR APPLICABILITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR RESOLUTION OF CONFLICTING ORDINANCES; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE.
The proposed amendments are intended to update the Countys LPPF ordinance to reflect changes in federal and state Medicaid financing programs, including the expansion of authorized Medicaid supplemental payment methodologies and recognition of hospitals eligible of exemption through Centers for Medicare and Medicaid Services (CMS) broad-based provider tax waivers. The amendments also clarify that assessment proceeds may be used to fund the nonfederal share of Medicaid supplemental payment programs authorized by CMS, including Directed Payment Program, managed care quality incentive arrangements, and other supplemental Medicaid payment programs designated by the Board through an Assessment Resolution.
The proposed amendments do not create a new assessment, increase any existing assessment, or approve an annual assessment roll. The authority to levy non-ad valorem special assessments against eligible hospitals was previously established by Ordinance No. 2022-67. Any future
assessment amounts will continue to be established separately by the Board through an Assessment Resolution.
Pursuant to 286.0105, Fla Stat., if a person decides to appeal any decision made by the Board with respect to any matter considered at such meeting, a record of the proceeding will be needed, and for such purposes, it may be needed to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
Copies of the proposed Ordinance may be obtained from the Office of Management and Budget, located at 1 Courthouse Square, Suite 4400, Kissimmee, Florida between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday.
